Terms and Conditions of the booking

1 - FIRST: Optimus Ibiza is a reservation center and acts as an intermediary between the Client or also called Tenant, and the Lessor or also called Owner, and the contractual relationship for the accommodation in the owners dwelling binds the latter and the Client or Tennant.

 

2 - RATES:  The prices displayed on the website of Optimus Ibiza are per housing and week. The mentioned rates are marked by Owner or Lessor without any extra amount to be charged for the intermediary services offered to the Client.

 

3 - GUARANTEE FOR THE RESERVATION: The conditions of guarantee requested to confirm the booking are detailed in the individual file of each property reserved. In case this information is not detailed, the following conditions will be considered valid:

 

In order to guarantee the booking 100% of the total of the stay should be paid in advance according to the following pre-payment schedule:

50% of the total of the stay should be paid at the moment of reservation and remaining 50% of the stay should be paid at least 15 days before the arrival date.

Once the first pre-payment is received the booking is considered confirmed and the Client will receive written booking confirmation by e-mail.

If 15 days before the arrival date the total of the stay hasn´t been paid by the Client the Owner can cancel the booking unilaterally and charge the penalties to the Client according to the conditions detailed in paragraph number 4, Cancellation Policy.

 

4 - CANCELLATION POLICY:   the cancellation policy for each property reserved is detailed in its individual file. In case this information is not indicated, the following conditions will be considered valid:

Total or partial cancellation should be sent by the Client in written form and the following cancellation fees are applied:

-        From the moment of the reservation and upto 60 days before the arrival date, 100€.

-        From 59 upto 15 days before the arrival date, 50% of the total amount of the stay will be charged,

-        From14 upto 0 days before the arrival date: 100% of the total amount of the booking will be charged,

-        In case of no-show the total amount of the stay will be charged.

 If for any reason not attributable to Optimus Ibiza or to the Owner, the dwelling, subject of the contract, is not available, Optimus Ibiza commits itself to search among its collaborators and on preferential basis a property with similar characteristics. If the suggested options don´t satisfy the Client, Optimus Ibiza will not be responsible for further claims of the customer for this reason.

 

5 - DEPOSIT: Each property has its own specific conditions concerning the payment of the deposit, indicated in the individual file of each property. If it is not detailed, the deposit is to be paid to the Owner upon signing the contract when the Client arrives to the house.

The deposit will be fully refunded as stated in the property file. If it is not detailed, the deposit will be refunded upon check-out or in its absence within 72 hours after the departure, unless some damages have occurred in the property during the stay. In this case, if the property file doesn´t indicate other proceeding, the deposit will be refunded within 15 days once the amount for the damages caused has been deducted.

 

 

6 - RESPONSABILITY: Optimus Ibiza only acts as a reservation center and as the intermediary between the Tenant/Client and the property Owner or Lessor. Optimus Ibiza in no case is responsible for the breach of any of those parties. In the event that, despite the above explained, Optimus Ibiza were found liable, the compensation in any case would not exceed the amount paid by the Client, which is expressed in the moment of booking of accommodation or service.

In no case Optimus Ibiza is responsible for personal injuries suffered by the client, companions or guests, or for robbery or theft suffered by any of them during their stay or transfer. The Client states that he/she hired his own holiday insurance.

 

7 - CUSTOMER SERVICE HOURS: Optimus Ibiza offers customer support service, with the following timetable: 7 days a week from 10.00 a.m. till 07.00 p.m. from May 1st till October 31st, both inclusive, and the rest of the year from 10.00 a.m. till 03.00 p.m. from Monday till Friday, excluding local bank holidays, at the phone number +34 665 892 973.

 

8 - EXTRA PERSON: The houses are equipped for a maximum number of guests. The surcharge to pay for each extra person is indicated on the file of the property on the web, and the number of extra beds can never exceed the maximum indicated on the file of the property. Some houses also have cots and high children chairs, these services are charged extra and the rates will be informed upon the request.

 

9 - MAXIMUM NUMBER OF OCCUPANTS:  The occupancy of a property by a number of people exceeding the one fixed in the contract will result in immediate cancellation of it and therefore in the extinction of the right to continue occupying the dwelling. So the Client will have to leave the property immediately without any right to reimbursement, establishing the penalty clause equal to 25% of the total of accommodation rate per week for each day the Client is late to leave the property since the contractual breach regulated in this paragraph has occurred.

 

10- OTHERS:  The properties are handed over fully furnished, equipped and in perfect conditions of use. In the price of all properties is included: water, gas, electricity supplies, bed linen and also bath towels. The property owner or his representative will be allowed to have access to the property at a reasonable hour during the daytime for inspection and maintenance purposes. No reservations made by children under 18 years old are accepted.

 

11 –PARTIES AND EVENTS: It is strictly prohibited to make any noise which can be qualified as acoustic contamination in the property or its outlets from 12.00 p.m. till 08.00 a.m. It is also forbidden to hold any party, celebration or event with number of assistants bigger than the one stated in the contract, unless previous advise and written and express acceptance of it by the Intermediary.

Generally, it is strictly prohibited any activity which breaks normal and peaceful co-existence of neighbors, as well as carrying out any insalubrious and dangerous activities and in general any activity forbidden by Spanish legal system.

If the Client breaks this rule, the Lessor reserves the right not to refund the damege deposit in full.

The contravention of the above mentioned prohibitions implies serious failure in contract´s fulfillment and will result in its immediate cancellation and therefore in the extinction of the right to continue occupying the dwelling. So the Client will have to leave the property immediately without any right to reimbursement, establishing the penalty clause equivalent to 25% of the total of accommodation rate per week for each day the Client is late to leave the property since the contractual breach regulated in this paragraph has occurred.

Moreover the Client is the only one responsible to pay the total amount of administrative fine which can be imposed.

 

12 - CHECK IN - CHECK OUT:  The time of check-in and check-out for each property reserved is detailed in its individual file, altogether with the special conditions/requests for the handover of the keys. In case this information is not detailed, the following conditions will be considered valid:

The schedule to entry into the properties is from 06.00 p.m. and until 10.00 p.m.  If you arrive later, please indicate it clearly in your booking form. Check out time is 10.00 a.m. as latest. Check-in and/or Check-out between 10p.m. and 6a.m. will have a surcharge of 50 € on the price of the reservation.

 

13 - PETS:   Each house has the information if the pets are accepted or not in its individual file. In any case prior advice is required and the type and quantity of the animals should be informed clearly by the customer in advance. If any damages are caused by pets they will be charged on the customer's account and deducted from the deposit.

 

14 - ACCESSIBLE FOR DISABLED PERSON:  If property is indicated like accessible for disabled or  for people with reduced mobility it will be explained clearly in its individual file which degree of adaptation it offers. This doesn´t mean that the property or its outlets carefully adapted for disabled people.

 

15 - ECOTAX:  This tax is not included in the prices published in the files of the villas. From the past July 1st 2016, according to the Law 2/2016 from March 30th 2016, this tax is charged on the touristic stays in the Balearic islands, with the following rates detailed below, by person, day and season:

High season (from May 1st till October 31st)

For stays for less than 9 days – 2 € per day

For stays for 9 or more days – starting from the 9^th day, reduced fee of 1 € is applied.

Law Season (from November 1^st till April 30^th)

For stays for less than9 days – 0,50 € per day

For stays for 9 or more days – starting from the 9^th day, reduced fee of 0,25 € is applied.

Children under 16-year-old are exempt from this tax.

This tax should be paid by the customer directly to the owner of the villa.

 

16 – BUILDING WORK:  The properties are privately owned and are largely situated in residential areas. They are not generally situated in areas with large tourist complexes. At times private or government building work can be taking place in the surrounding area. Neither Optimus Ibiza nor the property owner have any influence over this work and cannot be held responsible for building work or any disturbance it may cause.

 

17 - SUPPLIES: Cuts to the supply of water, electricity or internet are not regular. However the local authorities can occasionally cut or limit supplies for short periods of time. Optimus Ibiza can take no responsibility for any inconvenience caused by temporary cuts to supply. Ibiza island is not a big European city where there is high quality wifi everywhere. The provided connection is only for checking emails and usual Internet surfing.

 

18 - ONLINE RESERVATION: Online reservations made through our booking engine are subject to availability of the properties promoted on our website. We do our best to keep availability as much updated as possible, however since it is automatic process and each property has different sales channels, an unlikely event of overbooking may occur occasionally. In this case Optimus Ibiza commits to notify the Client as soon as possible, within 24 hours at most, and to find a property with similar characteristics and price. If the Client doesn´t like offered option, Optimus Ibiza will return to the Client the full amount paid during the reservation process.

Optimus Ibiza acts only as a Booking Center and Intermediary between the Client and the Owner or Contractor of the accommodation. In no case it will be liable for the damages caused to the Client by a reservation that could not be confirmed due to lack of availability or any other reason, so the Intermediary is exempt for any subsequent claim against it.

 

19 - PRIVACY OF YOUR DATA:  The personal information you provide us will be used to fulfill your requests for information and also to inform you of new activities, products and services of Optimus Ibiza, in compliance with the current data protection legislation: - Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons (RGPD). - Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights (LOPD). - Royal Decree 1720/2007, of December 21 (RLOPD). This privacy policy was edited on December 6, 2018. We may modify this privacy policy due to the modification of treatment criteria, in order to facilitate its understanding or to adapt it to current legislation. We will update the edition date, so you can check its validity.

This policy aims to guarantee and protect, with regard to the handling of personal data, civil liberties and fundamental rights of individuals, and especially their honor and personal and family privacy. Optimus Ibiza has a computerized database registered in the Spanish Agency for Data Protection in order to ensure the protection of personal data and guarantee the exercise rights of access, rectification, cancellation, opposition and assures that in no case your data is transferred to third parties for any commercial activity or other purposes without prior permission by the owner. In compliance with Law 34/2002 of July 11, Services Information Society and Electronic Commerce (LSSICE) you can revoke at any time, easy and free, the consent to receiving e-mail by sending an e-mail with your application, copy of ID, to info@optimusibiza.com

Failure to complete the mandatory fields that appear in any electronic registration form may have as effect that Optimus Ibiza will be unable to process your request. Personal information is collected with the purpose which is explained, and particularly identified, on each page with the electronic registration form. In the event that you provide us with personal data of third parties in compliance with Article 5.4 LOPD you state that such people have been informed previously of the contents of the data provided, of their origin, of the existence and purpose of the file which contains the data, of the recipients of such information, the possibility of exercising rights of access, rectification, cancellation and opposition as well as information identifying Optimus Ibiza in the terms and conditions herein. Optimus Ibiza is committed to treat their personal data as absolutely confidential, using them exclusively for the purposes stated.

Optimus Ibiza informs you that it has implemented security measures, technical and organizational, in order to ensure the safety of personal data and to avoid any alteration, loss, and / or unauthorized access, taking in consideration technological state, the nature of the data stored and the risks they are exposed, whether they are coming from human action or physical or natural means. All in accordance with the provisions of the Data Protection Act and Article 9 of Royal Decree 1720-1707 of 21 December, where the regulations on security measures for automated files containing personal data are approved.

 

20 - SPECIAL RULES: Optimus Ibiza, is an intermediary web-site for rental or purchase of properties on Internet and Internet user that accesses it, hereinafter the User, reach the following agreement: the User claim to be adult and have the legal capacity to assume the rules for using the portal. Mere access to it implies the unreserved acceptance of these rules.

The users of Optimus Ibiza accept give their data and that it can be seen in different information files of our website.

The establishment of a link to other pages in Optimus Ibiza does not imply any acceptance or relation between the pages which set it. The site has never authorized such links if any illegal and/or contrary to morals, to public order or to the current law content is exposed. For any link to any portal prior written authorization is required.

Optimus Ibiza reserves the right to review and change prices at any time.

Optimus Ibiza reserves the right to modify or update these terms and conditions periodically; the User will be subject to new rules.

Optimus Ibiza reserves the right to modify, increase or cancel at any time and without prior notice, the presentation, layout, content or services provided by it.

Optimus Ibiza will keep the service almost at 100%, however, because of inevitable external and technical constraints Optimus Ibiza accepts no responsibility for any temporal service interruption. In the case Optimus Ibiza interrupts the availability and continuity of its functioning and its services at any time or in the future, Owners will be informed properly to avoid any confusion arising from it.

The User agrees not to destroy, alter, disable or damage the database and not introduce or spread viruses or any electronic or physical element in the network that may damage others users equipment and/or the website.

In case that the service is interrupted because of force majeure and it affects the subject of this contract, because of any event or circumstance not contemplated by the parties, in accordance with stated in the Article 1105 Civil Code and according to the current legislation, Optimus Ibiza is not responsible for those events that could not be foreseen, or even being expected, were inevitable. This service obligation will be suspended for the time that is considered justifiable according to the Law.

Optimus Ibiza can interpret and modify these rules or other at its sole discretion to care for quality, interests, performance and good reputation of it.

Law and Jurisdiction:  all legal issues concerning Optimus Ibiza are governed by and are subject to Spanish legal system and jurisdiction, being territorially competent courts and tribunals of Ibiza (Spain).
